We provide website features and access to third-party products and services when you visit https://falconleasing.ca and https://go.falconleasing.ca, use Falcon Leasing products or services, use Falcon Leasing applications for mobile, or use software provided by Falcon Leasing in connection with any of the foregoing (collectively, the “Falcon Leasing Services”). Falcon Leasing provides the Falcon Leasing Services subject to the following terms and conditions (these “Terms”).
We offer a range of services depending on your needs. A majority of these Terms apply to all visitors, applicants, and partners. If these Terms are inconsistent with any specific service terms (including a credit/lease agreement or consent form you sign), those service terms will govern for that service.

THESE TERMS CONTAIN DISCLAIMERS OF WARRANTIES AND LIMITATIONS OF LIABILITY AND, WHERE PERMITTED BY LAW, REQUIRE ARBITRATION ON AN INDIVIDUAL BASIS AND WAIVE CLASS ACTIONS (SEE SECTIONS 14–16). Subject to your continued compliance with these Terms, Falcon Leasing grants you a revocable, limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Website for personal, non-commercial purposes related to exploring or obtaining Falcon Leasing Services. You acquire no ownership rights in any Website content. You must not copy, distribute, modify, reverse engineer, mine, or scrape the Website or its content except as permitted by law.
Your submission of personal information through the Website is governed by our Privacy Statement posted on the Website. Falcon Leasing may update its Privacy Statement from time to time. The Privacy Statement is incorporated by reference into these Terms.
You may be required to create an account and/or submit information (e.g., finance application data). You represent and warrant that all information you provide is true, accurate, and complete, and you will promptly update it as needed. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
Submitting information on the Website (including financing applications or vehicle inquiries) does not constitute an offer or acceptance by Falcon Leasing. All approvals, offers, and terms are subject to verification, credit adjudication by Falcon Leasing and/or third-party lenders, availability of vehicles, and execution of definitive written agreements. We may request additional information, decline applications, or limit services at our discretion.
Certain services may require application fees or deposits as disclosed at the time of request or in a separate written agreement. Unless otherwise stated in a specific agreement or required by law, application fees are non-refundable once submitted, and deposits are refundable/forfeitable according to the terms disclosed at the time of payment or in your definitive agreement. Falcon Leasing generally does not sell digital products or subscriptions through the Website; if we do, any specific refund/renewal terms will be presented at checkout or in service-specific terms.
By using the Website or providing contact details, you consent to receive communications from us electronically (including email, SMS/MMS, phone calls—including automated or prerecorded messages where permitted—and in-account messages). You agree that electronic communications satisfy any legal requirement that such communications be in writing, to the extent permitted by law. You may withdraw certain marketing consents as described in our Privacy Statement; transactional/service communications may still be sent.
You can cancel the SMS service at any time. Simply text "STOP" to the shortcode. Upon sending "STOP," we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you.
We may present or connect you with third-party services (e.g., lenders, insurers, dealers, vehicle delivery/logistics). Those third parties are solely responsible for their services and terms; Falcon Leasing is not responsible for third-party acts or omissions. Your dealings with third parties are between you and them.
Pricing and availability for vehicles, services, fees, and related offerings may be displayed on the Website or provided by our team and are subject to change without notice. Except where expressly stated, prices are in Canadian Dollars (CAD) and exclude applicable taxes, fees, and charges. Errors and omissions are excepted; if a pricing or availability error is discovered, we may correct it and provide you the option to proceed or cancel.
Financing outcomes, payments, rates, terms, and approval decisions vary based on your credit profile and other factors. No outcome is guaranteed. Falcon Leasing does not provide tax, accounting, financial, or legal advice; consult your own professional advisors.
You agree to use the Website and Services only for lawful purposes and to comply with all applicable laws and regulations (including credit, marketing, privacy, and consumer protection laws). You are responsible for ensuring that information you provide is accurate and authorized.
Where you submit testimonials, reviews, or media, you grant Falcon Leasing a worldwide, royalty-free, transferable license to use, reproduce, display, and distribute such content (including your first name/initials and city/province) for marketing and operational purposes, subject to our Privacy Statement. Testimonials represent individual experiences and are not guarantees.
You must comply with all applicable Canadian laws (and, if outside Canada, your local laws) including those governing advertising, privacy, electronic communications, and anti-spam. You are solely responsible for ensuring your compliance.
EXCEPT WHERE PROHIBITED BY LAW: THE WEBSITE AND ALL CONTENT AND SERVICES AVAILABLE THROUGH IT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE WEBSITE WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT DEFECTS WILL BE CORRECTED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW: FALCON LEASING AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE WEBSITE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE WEBSITE OR THESE TERMS SHALL NOT EXCEED CAD $100 OR THE AMOUNT YOU PAID TO US FOR THE SERVICE GIVING RISE TO THE CLAIM IN THE 3 MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER. SOME PROVINCES DO NOT ALLOW CERTAIN LIMITATIONS; SOME LIMITATIONS MAY NOT APPLY TO YOU.
Where permitted by applicable law, you agree that any dispute or claim arising out of or relating to these Terms or the Website shall be resolved by final and binding arbitration on an individual basis, and not as a class or representative action. The seat of arbitration shall be Winnipeg, Manitoba, administered under the Arbitration Act (Manitoba) by a mutually agreed arbitrator. You waive any right to a jury trial and to participate in a class action, to the extent such waivers are enforceable in your jurisdiction. If a court finds the class waiver unenforceable, the arbitration clause shall not apply and the dispute shall proceed in the courts identified in Section 23.
We may seek injunctive or other equitable relief to prevent or limit irreparable harm in the event of your breach or threatened breach, in addition to any other remedies available at law or in equity.
You agree to defend, indemnify, and hold harmless Falcon Leasing and its directors, officers, employees, agents, licensors, and suppliers from and against all claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or related to (a) your breach of these Terms, (b) your misuse of the Website or Services, or (c) your violation of law or third-party rights.
We respect intellectual property rights. If you believe content on the Website infringes your copyright, please contact us (see Section 30) with details of the work claimed to be infringed, the location of the material, and your contact information. We may remove content at our discretion.
The Website may contain links to third-party sites. We do not endorse and are not responsible for third-party sites or resources. Your use of third-party sites is at your own risk and subject to their terms.
We may terminate or suspend your access to the Website or Services, with or without notice, for any reason. Upon termination, provisions that by their nature should survive (including ownership, disclaimers, limitations of liability, and indemnities) will survive.
Failure to enforce any provision is not a waiver. Any waiver must be in writing and signed by Falcon Leasing.
These Terms are governed by the laws of the Province of Manitoba and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules. Subject to Section 16, the courts of Manitoba (Winnipeg Centre) shall have exclusive jurisdiction.
We will not be liable for any delay or failure due to causes beyond our reasonable control, including acts of God, labour disputes, supply chain issues, power or internet failures, or government action.
You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, financing, or sale of assets.
You agree that your interactions with the Website and any “click-to-agree,” typed name, or electronic consent constitute your electronic signature and agreement, to the extent permitted by law.
We may modify these Terms at any time by posting the updated Terms on the Website with a new “Last Updated” date. Material changes will be highlighted where practicable. Continued use after changes constitutes acceptance.
You represent that you are using the Website in your personal capacity or on behalf of a business you are authorized to bind; that you will comply with applicable laws; and that you will not use the Website for any fraudulent, misleading, or unlawful purpose.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect, and the invalid provision will be replaced with a valid provision that most closely reflects the parties’ intent.
